Acceptable Use Policy

The rules for using our network, connectivity and hardware responsibly and lawfully.

1. General Notice & Acceptable Use Policy (AUP)

Welcome to Somangaye Internet. By accessing our website or using our services, you agree without limitation or qualification—to comply with this Acceptable Use Policy (AUP), our Terms and Conditions, and any other applicable policies or notices displayed in connection with our services.

2. Purpose of the AUP

This AUP is designed to:

  • Ensure compliance with the laws of the Republic of South Africa.
  • Define acceptable and unacceptable online behaviour.
  • Protect the integrity and performance of our network.
  • Outline the consequences of policy violations.
Somangaye Internet respects your constitutional rights, including freedom of speech, access to information, privacy, and belief. We will not interfere with these rights unless required by law or if such rights are exercised in a way that harms others or compromises our network.

. Prohibited use

You may not use our services to:

  • Send unsolicited bulk email (spam), or relay mail on behalf of a third party without consent.
  • Distribute malware, run port scans, or attempt unauthorised access to any system.
  • Host or distribute content that infringes copyright, trademark or other intellectual property rights.
  • Host or distribute unlawful, defamatory, hateful, or child sexual abuse material.
  • Operate open proxies, open relays, or services designed to conceal the origin of abusive traffic.
  • Interfere with or degrade the network experience of other customers, including through excessive automated traffic.
  • Resell bandwidth or capacity without a written reseller agreement with Somangaye.

3. Fair usage

Uncapped products are subject to a Fair Usage Policy. Where a line consistently exceeds typical residential or business usage patterns and materially affects network capacity for other users, we may apply traffic shaping, throttle the connection during peak hours, or contact you to discuss a more suitable plan. Specific thresholds for each product are listed on the relevant service page.

The following activities are strictly prohibited:

  • Hosting private servers, VPNs, email, or network services.
  • Use by Wireless Internet Service Providers (WISPs)
  • Unattended automated processes.
  • Any non-personal use that places an excessive burden on the network
To maintain optimal performance for all users, we reserve the right to manage users who exceed fair usage thresholds. Speed limitations apply once the monthly usage limit is reached and reset on the 1st of each month.

5. MTN Home Internet – Fair Usage Policy

Service-Specific Usage Policies

The following activities are strictly prohibited:

  • Hosting private servers, VPNs, email, or network services.
  • Use by Wireless Internet Service Providers (WISPs)
  • Unattended automated processes.

6. Telkom Uncapped Home Internet – Fair Usage Policy

To maintain optimal performance for all users, we reserve the right to manage users who exceed fair usage thresholds. Speed limitations apply once the monthly usage limit is reached and reset on the 1st of each month.

Additional Network Management

Telkom reserves the right to further throttle or terminate service for users whose behaviour negatively impacts network performance. This includes:
  • Excessive concurrent sessions
  • Use of bandwidth-intensive protocols (e.g., Peer-to-Peer, NNTP)
  • Activities that cause network congestion
  • These measures are in place to ensure a stable and fair experience for all users on the Telkom network.

      7. Network Management & Capacity

      Somangaye Internet works in close partnership with Vodacom, MTN, and Telkom to ensure fair access and optimal performance for all users. While we strive to maintain consistent service quality, please note that full network capacity cannot always be guaranteed, especially during peak usage periods.

      8. Network integrity & security

      You are responsible for securing any router, ONT, modem or other equipment on your premises. Somangaye may isolate a connection that is compromised (for example, part of a botnet) until the issue is resolved, to protect the wider network.

      9. Lawful interception & RICA

      As a South African electronic communications provider, Somangaye complies with the Regulation of Interception of Communications and Provision of Communication-related Information Act (RICA). SIM cards and certain services require RICA registration before activation.

      10. Reporting abuse

      Suspected abuse of our network can be reported to abuse@somangayeinternet.co.za. Include full headers, logs or timestamps where possible so we can investigate.

      11. Enforcement

      Breach of this AUP may result in a warning, temporary suspension, permanent termination of service, or removal of hosted content, at our discretion and depending on severity. Where required by law, we may also report unlawful activity to the South African Police Service or the relevant regulator.

      12. Changes to this policy

      We may update this AUP from time to time to reflect changes in our network, products, or the law. The date at the top of this page reflects the latest version. Continued use of our services after an update constitutes acceptance of the revised AUP.
